A Trade Mark Registration provides you with exclusive rights to prevent others from using substantially identical or deceptively similar Trade Marks for similar goods or services to your own.

Does registering my business name mean I have a registered Trade Mark?

Registering a business name is not the same as registering a Trade Mark. 

For example, in Australia a “Business Name”, must be registered with the Australian Securities and Investments Commission (ASIC) in order to legally trade in Australia. A key purpose of which is to enable the public to identify the person(s) behind the Business Name.

The registration of a Business Name provides no rights to prevent other traders using a similar name.

That is why it is important to also register your Trade Mark to protect your business.
